Eligibility Criteria
The process of applying for a US K-3 Marriage Visa is begun outside the United States but completed within the country. Applications must be made in the country where the foreign spouse resides permanently and the following eligibility criteria must be met:
  • Parties must be legally married and able to produce a valid Marriage Certificate. Unmarried cohabitation is not included in this category and unmarried partners may not sponsor USA visas.
  • The sponsoring party must be over 18 years of age in order to sign an affidavit or support.
  • In addition, a selection of documentation will be required including the applicant's passport, medical examinations and police clearances, proof of the petitioner's (sponsor's) citizenship, marriage certificate and where applicable documentary evidence of the termination of any previous marriages.
Once a K-3 is issued by a foreign US Embassy and the bearer enters the United States, they may begin the process of obtaining their US Green Card and Employment Authorization Document (EAD). Marriages which have existed for less than two years will be open to an initial conditional arrangement. USA Green Cards will initially be granted in these circumstances for a period of two years. If the marriage is still intact, both parties should apply no later than 90 days before the expiry of the two-year period to have this condition removed.

Dependents
The K-3 class is designed as a means to permanent settled status in the USA, allowing existing US citizens to be united with their spouses in America. As the K-3 is a route to permanent residency, it also makes provision for dependent immigration, to encompass the immigration needs of any of the foreign spouses' children. Dependent children of the sponsored applicant may migrate to the USA on a K-4 visa, a non-immigrant route designed to allow the holder to wait in the USA until the immigration process is completed. In order for US K-4 visas to be granted applicants must be the children of valid holders of K-3 American visas.

There are 2 ways for you to get a Vietnam visa:

1. Apply for your Vietnam visa in a Vietnam Embassy / Consulate:
Since there is no Vietnam representative office in Burundi at the present, you can check other countries to find the nearest Vietnam Embassy / Consulate to contact.

In case it is so inconvenient for you to come in person to a Vietnam embassy, applying for a Vietnam visa by post is recommended. However, please contact the embassy in advance to check whether you can obtain a Vietnam visa by post or not.

2. Apply online (1) to obtain an approval letter (2) to pick up your Vietnam visa at Vietnam international airports (in case you travel by air to Vietnam) or to collect your Vietnam visa at any Vietnam Embassy / Consulate nominated by you.

a) Regarding apply online to obtain a visa approval letter to pick up visa at a Vietnam international airport, there are 3 options based on the purpose of your visit:

- Vietnam visa for business purpose with validity for 1 month, 3 months or 6 months.
- Vietnam visa for tourist purpose with validity for 1 month only.

- Vietnam visa for transit purpose with validity less than 5 days then visa holders must depart to a third country after 5 days in Vietnam at maximum. You will be granted a transit visa on the condition that you travel by tour and the group must have clear schedule and indemnify of a travel agency that organizes the tour.

The applicant must submit:

1. Original PASSPORT (which requires at least 01 month validity prior the date of exit from Vietnam and/or 06 month validity to meet airlines’ requirements). 2. Application form (click here to download PDF form /or Word form): The form must be completed, signed and attached with 01 original photo (2x 2in) . In case of a loose-leaf-visa request, 01 additional photo must be stapled to the form. If the applicant has already got A visa approval, she/he may write the reference number on the top of the form. For anyone who comes to Vietnam for less than 3 months and does not have visa approval, just leave “visa approval number” blank and the Embassy will take care of it. Additional processing fees for visa approval may be required.

3. Visa fees must be in the form of MONEY ORDER, or CASHIER’S CHECK, or CERTIFIED CHECK payable to “THE EMBASSY OF VIETNAM.” Applicants applying together may submit combined payment in one money order or certified check. Fee for stamping visa can be checked at Consular Fee. Once visa has been applied, the fee is NOT refundable.

4. A prepaid return envelope, if the applicant requests the visa be returned by mail. Please use USPS - United States Postal Service (prepaid postage stamp envelope or return label bought online at www.usps.com) or prepaid return FedEx label (bought online at www.fedex.com. For your documents’ safety, the Embassy advices to use USPS Express Mail or FedEx with the tracking numbers. In case the package is lost, applicants is fully responsible for the problems that may occur.

Applicants applying together may provide one envelope for visas to be returned to the same address.

Processing Time: Five business days are required to process visa applications with approval. Expedited processing requires one to two business days after the Embassy has received the application (additional fee required).

Note: Please keep the tracking numbers of the envelopes to and from the Embassy. When the above deadlines have passed, use the tracking number to check with the mailing service first. Please do not make telephone inquires on the status of your application (make sure that you keep your passport number for this request) until after the 3rd business day for an expedited case and the 7th business day for a regular case. The Embassy will be closed on Saturday, Sunday, Vietnamese and US holidays 2011. Please take account of the observed holidays in planning for your visa application and travel. In addition, no mail can be delivered at the Embassy during weekends and holidays.
